A smart Lucius! One who realizes just how bad Voldy's return can be for his family. And he's going to trade the lives of the other death eaters for the safety and prosperity of the Malfoy's. But once Pettigrew is put infront of the Wizengamot, Sirius will be freed and the Black family be out of his hands. And since he would have sacrificed much of his allies in the Wizengamot to kill Voldy he would be weakened politically.

Lucius is probably the most cunning character of them all. He lost one of Voldy’s horcruxes and managed to not be immediately killed over it. He avoided Azkaban completely by bribing politicians. He had the minister under his thumb. He even got away with unleashing a Basilisk on the students of Hogwarts. Anybody else would be thrown in Azkaban.

TFTC. Yeah, Lucius actions did make sense, even in canon he was terrified of the Dark Lord. There is no way he would want his child to suffer under Voldemort like he and other Death Eaters did. Though, I expect a twist since the author is quite good at those.
