As for why Milotic is level just reach 39 not 40 or above. It is because of special circumstances or people usually say bottleneck. All pokemon without exception will meet bottleneck when start to break through to the Gym Leader or higher. The higher the level, the harder for Pokemon to break through it.

And the only way to break through it is to fight. The fight that makes Pokemon tap her/his potential and let it break through. More high the potential is, the easier for Pokemon to break through.

Just like, Jovan is Gourgeist who is stuck at level 99 because she has not met a decent opponent that can bring her a serious fight to breakthrough. Maybe Roserade and Blissey can help when they reach level 99 later.

As for why level 99, it is like I said higher the level, the harder Pokemon to break through. Even though Gourgeist at this time is already Golden quality but the battle between her and Roserade or Blissey is not enough to make her breakthrough. Jovan already tries it.

So Jovan makes a conclusion it is either level 99 or above that can help Gourgeist to break through.
